Data Processing Addendum
The short version
- For data you store with us, you're in charge; we act only on your instructions.
- Only K-Jensen LLC can access it, and only to run the service or when you ask.
- We name our suppliers, encrypt offsite copies, and tell you promptly about a breach.
- When you leave, you can export everything, and we delete it on schedule.
This summary helps you read the document; the full text below is what applies.
This addendum is part of our Terms of Service. It applies to personal information about other people that you store in or send through Kagen Cloud and Kagen Mail ("Customer Personal Data"): for example your customers' details in your website's database or the mail in your mailboxes.
1. Roles
You decide what Customer Personal Data you store and why; you're the business (or controller). K-Jensen LLC processes it only on your behalf to provide the Services; we're your service provider (or processor).
2. What we'll do
- Follow your instructions. We process Customer Personal Data only to provide the Services, as you configure them, and as the law requires. We don't sell it, share it for advertising, or use it for any other purpose.
- Keep it confidential. Only K-Jensen LLC can access it, and only when needed to run, support or secure the Services, or when you ask us to.
- Keep it secure. Encrypted connections, customers isolated from one another, access limited and logged, backups encrypted before they leave our data center, and regular restore tests. See our Privacy Policy section 7.
- Tell you about breaches. If we become aware of unauthorized access to Customer Personal Data, we'll tell you without undue delay, with what we know, and help you meet any obligation you have to notify others.
- Help with requests. If someone asks you to access, correct or delete their information, we'll help you do it, mostly through the portal.
3. Suppliers (subprocessors)
We use a small number of suppliers, listed in our Privacy Policy section 4. Offsite backup copies are encrypted with keys only we hold. We'll update that list at least 30 days before adding a supplier that can access Customer Personal Data, so you can object; if we can't resolve your objection, you may close the affected service without penalty.
4. Where it's processed
Customer Personal Data is stored in the United States (our data center in Atlanta, Georgia). Encrypted backup copies are also kept in Germany. Website traffic may pass through our edge servers in the United States and Germany.
5. When you leave
You can export Customer Personal Data at any time. After you delete a resource or close your account, we delete the data, and it ages out of backups on their normal schedule. We keep it longer only where the law requires.
6. Your responsibilities
You confirm you have the right to collect and store Customer Personal Data, that you've told people what you do with it where the law requires, and that you won't instruct us to process it unlawfully.
7. Questions and audits
We'll answer reasonable questions about how we protect Customer Personal Data. Email support@kagen.cloud.
